The listing indicates that the apartment has “roof rights”. How can I be sure?Review all documents carefully. The right to exclusive use of a portion of the roof or other common area can be a valuable amenity. New developments usually make the unit owner’s rights clear. That’s not always the case with older co-ops or condos. Sometimes exclusive rights are clearly spelled out, sometimes not. In some cases, rights were created years after the conversion of the building. The Offering Documents, other organizational documents and Board minutes must be reviewed carefully to make sure you are getting what is stated in the listing or the contract of sale.
