The Seller removed an expensive chandelier right before Closing. Is that permitted?It depends. A light that is affixed to the ceiling or to a wall is considered a “fixture” and should remain in the apartment after closing, unless the contract provides otherwise. Basically, everything other than furniture is included in the sale, unless specifically excluded. A seller who forgets to exclude an expensive light fixture or one that has sentimental value, can make a very costly error. That can apply to custom made curtains and window treatments as well. The printed form includes those items, unless specifically excluded by the seller. If the seller wants to remove specific light fixtures or other items that are usually included in the sale, those items should be excluded in the contract to avoid dashed expectations and breaches of contract.
